The family of a boy who allegedly suffered brain damage during birth at the University Hospitals was awarded $11.7 million by a Cook County jury last week. Marshawn Davis, who is currently 13 years old functions at the level of a preschooler.
According to Barry Chafetz, the family’s attorney, Davis’s mother had to wait 35 minutes for an operating room so that she could have an emergency Caesarean section in 1988. The family claims that Davis’s brain damage was caused by the delay during the period of fetal distress.
The University Hospitals said that the operation was not delayed and that the mental retardation could not have been caused during delivery. They are planning to appeal the decision.
